Policies
Future Business Solutions, Inc. (FBS.NET) is a provider of Internet and computing services, offered for a fee to the residents and businesses of Central Florida. We want all our customers to have a pleasurable experience with the Internet and require a few guidelines to be followed:
ACCEPTABLE USE
This Acceptable Use Policy specifies the actions prohibited by FBS.NET to users of the FBS.NET network. FBS.NET reserves the right to modify the Policy at any time, effective upon posting of the modified Policy to this URL: http://www.fbs.net/policy.shtml.
UNLIMITED USE. FBS.NET offers a variety of services designed to meet the needs of its clients. Dial-up access services include unlimited INTERACTIVE use. This means you can browse the web, check mail, read newsgroups or whatever you want as much as you like. It does not mean you can keep your connection active all the time by using automated mail checking, keep-alive packets or any other non-interactive method. Dial-up accounts are subject to a 30 minute inactivity timeout and a 8 hour unconditional timeout. Once either timeout is reached, your connection will be dropped but you can re-connect immediately. Any attempt to circumvent this policy will result in your dial-up account being classified as a (more expensive) dedicated access account. Our discretion in this matter is final.
ILLEGAL USE. The FBS.NET network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
SYSTEM AND NETWORK SECURITY. Violations of system or network security are prohibited, and may result in criminal and civil liability. FBS.NET will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:
- Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
- Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
- Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks.
- Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
EMAIL. Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site. Unsolicited email sent through another provider's network will be treated as if it were sent through the FBS.NET network if such email advertises sites hosted on the FBS.NET network. If you are unsure about what is permitted, ask BEFORE you mail.
USENET. Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting, also known as "SPAM") is explicitly prohibited.
UNAUTHORIZED SERVERS. Operation of any public Internet server, including, without limitation, file sharing (Kazaa, Morpheus, Napster, etc.), web, ftp, name, mail or news servers is prohibited for all residential customers. Business customers may operate a single public mail server for their own email, so long as it is properly configured and is not an open relay. Operation of a web or ftp server is prohibited over anything less than a full T1 connection. The operation of a public name (DNS) server other than a cacheing-only name server is prohibited. Windows 2000 and 2003 Server act as a name server by default. If you operate such a server, please disable all upstream DNS broadcasts. The use of Napster, Morpheus, Kazaa and/or any similar file sharing program, running in server mode, is prohibited (and in some cases, illegal).
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A FBS.NET CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.
Complaints regarding Illegal Use, System or Network Security issues, email abuse, USENET abuse or SPAM should be sent to abuse@fbs.net.
PAYMENT FOR SERVICES
Internet and scheduled maintenance services provided by FBS.NET are billed in advance during the first week of each month. Payment is due before the last day of that same month. Most other merchandise and service sales are billed as "Due Upon Receipt" a but are treated as "Net 10 Days" to allow for reasonable processing time. Orders for merchandise or services that are customer specific (such as open license software, web design, etc.) must be prepaid. Any invoice not paid on time will be charged a late fee of $10 or 10% of the past due amount, whichever is greater. This is NOT a finance charge - we do not offer financing but we do accept major credit cards. Returned checks will be charged $25 or 10% of the check amount, whichever is greater. All billing questions should be addressed to billing@fbs.net.
DEPOSITS
FBS.NET may require a deposit for services that bill in excess of $100 per month. Deposits may be returned after one year of on time payments. Deposits WILL NOT be returned if service is cancelled with less than 30 days notice.
CANCELLATION OF SERVICE
You may cancel service with FBS.NET at any time but it MUST be done in writing. Cancellation requests should be addressed to billing@fbs.net or mailed to FBS.NET, 940 Centre Circle, Suite 2004, Altamonte Springs, FL 32714. There will be no refunds of payments made before cancellation. Deposits held by FBS.NET will only be refunded if written notice of cancellation is received 30 days in advance. Note, while FBS.NET does not require contracts for any of its services, some telecommunications services (such as T1 circuits) do have minimum terms, set by the carrier. You will be required to pay any early termination fees assessed by the telephone companies.
REFUNDS
As a rule, FBS.NET does not issue refunds for unused service. Exceptions may be made on a case by case basis, at our discretion. If you believe you have a legitimate reason to request a refund, please direct your request to billing@fbs.net.
REMEDIES
Violations of any of these policies will be dealt with swiftly. Upon verification of said violation, all services to the offending party may be terminated without further notice. FBS.NET may, at its discretion, issue a warning on the first offense. In the event that services are terminated, all monies paid to FBS.NET will be forfeited.
ACCEPTANCE
